This action arises out of an affidavit for robbery filed November 3, 1953. The alleged robbery was said to have been committed by Jesse Claude Sinks and Shirley Henry Taylor on November 2, 1953, against one Leslie Begley. It is alleged that said appellants took United States currency of the value of $85.00 from said Begley. Each appellant pleaded not guilty to the charge, appellant Sinks being tried by jury and appellant Taylor tried by the court. As a result of their separate trials each appellant was found guilty and sentenced to the Indiana State Prison for not less than 10 years nor more than 25 years.
